STRIVE PERFORMING ARTS - TERMS AND CONDITIONS

By agreeing to the Strive Performing Arts (“Strive”) online enrolment form you have completed, you are deemed to have agreed and accepted the following terms and conditions of enrolment:

1. Enrolment Policies

(a) All Strive classes have a maximum capacity of student numbers for health and safety reasons.

(b) Enrolment to a class is on a first come first serve basis.  If you miss an intake to a class you can be put on a waiting list.

(c) Strive classes usually commence on the first week of each school term (check our important dates tab to confirm) and run for a period of 8 to 12  weeks, depending on the relevant term (an “Enrolment Term”).

(d) Students shall be automatically re-enrolled for the following Enrolment Term for classes they are currently enrolled in for any Enrolment Term.  If a student does not wish to continue with a class for the following Enrolment Term, written notice must be provided in accordance with clause 1(e).   If a student does not provide the required notice, they will be liable for full payment of the fees for the relevant Enrolment Term in accordance with clauses 2 and 3.

(e) If at any time a student wishes to terminate their enrolment for any class, written notice must be provided to Strive at the following email address: striveperformingarts@gmail.com.  For avoidance of doubt, verbal cancellation will not be accepted.

2. Fee Policies

(a) Enrolment Term fees are payable in full within the week prior to the first day of the relevant Enrolment Term.

(b) Full payment of Enrolment Term fees are due regardless of whether or not the student attends classes.

(c) Strive does not accept part payment of fees unless at the discretion of the director.  This must be organised via email at striveperformingarts@gmail.com.

(d) If Strive believes, in its sole discretion, that a class will reach its maximum capacity, Strive reserves the right to ask for immediate payment of fees to secure a student’s place.

(e) Failure to make payment as noted in clause 2(c) within 3 days of receipt of the payment request means Strive shall be able to forfeit the student’s place in the intending class.

3. Fees

(a) The following fees are inclusive of GST, and are currently applicable for an Enrolment Term and are the total fees for each Enrolment Term:

(i)  School classes are $100

(ii) Public classes:

(1) All classes of 30-35 minute duration $10

(2) All classes of 45 minute duration $120

(3) All classes of 1 hour duration $150

(4) All classes of 1 hour 15 minute duration $165

(5) All classes of 1 hour 30 minute duration $175

(b) For the avoidance of doubt, the fees noted at clause 3 are based on a 9 to 10 week Enrolment Term, with a minimum number of 9 weeks, to take into account any consideration for a statutory holiday.

(c) Fees are:

(i)  not refundable for missed classes; and

(ii) not reduced or refunded for sickness.

(d) Failure to pay the fees as per clause 2(a) may result in the loss of the student’s enrolment and penalty charges as noted at clause 3(e).

(e) If fee payment is not received by the beginning of week three (3) of an Enrolment Term, you acknowledge and agree that Strive will add a 10% penalty fee to the full Enrolment Term fee payable.

(f)  If fees remain unpaid at the end of an Enrolment Term, Strive may in its sole discretion:

(i)  exclude students from annual performances; and

(ii) engage a debt collection agency to recover the fees.  You will be liable for any additional costs associated with the debt collection and recovery.

(g) Strive may, at its sole discretion amend the fees set out at 3(a), and the new fees shall apply from the start of the next Enrolment Term.  Strive shall notify you 4 weeks before the start of next Enrolment Term if there are any changes to the fees.

4. Refund and Cancellation Policy

(a) Subject to clauses 4(b) and (c), Strive will not give a refund in any circumstances, including, without limitation:

(i) Absences from classes due to illness, injury or personal circumstances.

(ii) Classes missed due to a change in mind.

(iii) Classes missed due to holidays.

(iv) Classes missed due to public holidays.

(v) Cancellation of enrolment by the student.

(b) If a student’s enrolment is cancelled prior to the start of week three of an Enrolment Term Strive will refund the fees paid by the student, less a proportionate cost for any classes attended by the student and a $20 administration fee, provided that the student has notified Strive of the cancellation in accordance with clause 1(e).

(c) If after week three of an Enrolment Term a student has notified Strive of the cancellation in accordance with clause 1(e) and has a medical certificate to confirm illness or injury, or bereavements, refunds will be given at the discretion of the director of Strive.

(d) If Strive cancels a class once an Enrolment Term has begun, Strive will refund the fees received less a proportionate cost for the classes that have taken place during the Enrolment Term prior to cancellation.

(e) If an individual class is cancelled by Strive, a makeup class will be scheduled or students will be given a refund to the amount of that individual class.

5. Payment Options

(a) Payment of the fees can be made via the following options:

(i) Internet banking to Strive’s ASB bank account: “Erin Chester Trading As Strive Performing Arts” 12-3438-0049240-00.

(ii) Cash at the Strive studio by appointment only.

6. Behaviour Expectations

(a) All students are expected to show up on time for class each week in appropriate attire.

(b) Strive works to maintain a friendly healthy environment for learning, all students and parents/caregivers must show respect towards the teacher, Strive management, other parent/caregivers and other students at all times. Strive teachers and management reserve the right to:

(i) disallow disruptive students and/or parents/caregivers from participating in the class

(ii) immediately dismiss for the remainder of a Enrolment Term disruptive students and/or parents/caregivers from attending classes at Strive. If a student and/or parent/caregiver is dismissed from the remainder of the Enrolment Term classes, Strive will refund only the untaken classes that have been paid for in advance.

(c) If you are having any issues they should immediately be directed to the Strive office via email communication.  Strive will endeavour to respond to your concern within 5 working days.

(d) No food is permitted in the studio

(e) Chewing gum and bubble gum is strictly forbidden.

(f) All students are recommended to bring their own water bottle to class. Due to health and safety regulations Strive does not provide glasses for students.

(g) Noise by students and parents/caregiver in and outside the studio must be kept to a minimum to ensure minimal distraction to a class.

7. Class Attire and Uniforms

(a) Strive does not have specific uniform requirements, with the exception of performance and competition team classes.

(b) Students may attend class in bare feet or soft flexible shoes.  Bare feet are required for acro classes.

(c) Please ensure all students' belongings are named.

8. Health, Safety, Injury and Medical Policies and Procedures

(a) While Strive takes all reasonable care in the conduct of its classes, it or any Strive related company, contractor or employee of Strive, does not:

(i) accept responsibility for personal injury or loss caused during a class or while students are at any location in which Strive classes or events are held.

(ii) accept responsibility for any loss of, or damage to, personal property whilst at any location in which Strive classes or events are held.

(b) Strive aims to provide a safe environment to reduce the risk of injury. However, it is acknowledged by the student and the parent/caregiver that dance by its nature carries a risk of accident or injury.

(c) It is the responsibility of the student or parent/caregiver to notify the teacher in the event of an injury or medical condition prior to class. Students and parents/caregivers are responsible to ensure that their child/ren are physically and mentally fit to attend a class.

(d) The student and parent/caregiver understand, agree and accept that safely spotting moves to reduce the risk of injury, correcting posture, alignment and technique requires physical contact between the teacher and student.

(e) Strive provides teachers that actively promote safe dance practices and are qualified and/or experienced and well trained in dance. However, it remains the student’s responsibility to ensure that they follow safe practices to avoid injury. At all times during a class students are responsible for their own personal safety and must conduct themselves in a way that does not put themselves or others at risk.

(f) A first aid kit is available to any student with permission from the teacher. Strive does not dispense any medication to any of the students.

(g) By bringing your child/self to Strive Performing Arts, you understand that while proper care will be taken to reduce risks through preparation, training and putting safety measures into place such as using mats, there are risks of physical injury associated with both dancing and acrobatics.  As you recognise this risk you knowingly and voluntarily waive all rights and causes of any kind, including but not limited to, injury and negligence while attending a Strive class or event.  You hereby agree to release Strive Performing Arts and hold Strive Performing Arts harmless of all liability and acknowledge that you knowingly and voluntarily assume full responsibility of all physical injury arising out of active participation in dancing and acrobatics.  You have agreed to this release of liability freely and of your own free will. 

(h) Strive students are only under supervision whilst in class time only. Teachers and staff will not be responsible for students outside their allocated class time and children in waiting areas must be supervised at all times. For safety reasons, students must be collected from inside the Strive premises. It is the responsibility of the parent/caregiver to ensure their child/ren do not wait outside the building. If a parent/caregiver is more than 10 minutes late in collecting their child/ren from a final class of the evening and Strive is required to keep the premises open, Strive will be entitled to charge a late pick up fee of $10 per 5 minute time slot.

(i) Running on any Strive premises is strictly forbidden.

9. Photography and Video Policies

(a) Photography and videoing of students in class and concerts is not permitted. This is for the safety and wellbeing of each student and to comply with the Privacy Act 1993 regulations.

(b) Strive Performing Arts will occasionally photograph/video students and may use video footage or pictures for promotional or training purposes.  These remain the sole property of Strive. Please make Strive aware if you do not wish for your child to appear in any marketing or promotional photos.  Unless Strive has been notified in writing, you are agreeing for your child’s picture and/or video to be taken and to be used on any form of advertisement for Strive Performing Arts or Strive event. If any images are going to be used more widely you will be contacted and an agreement arranged.

(c) Any footage of any choreography taken by a parent/caregiver or student remains the property of Strive.

10. Annual Performance

(a) All students enrolled at Strive are invited to dance in the annual performance which takes place in late November or early December.

(b) Each student that participates in the annual performance is required to attend extra rehearsals and all performances they are allocated to perform in.

(c) In addition to clause 9, all recording at the annual performance is prohibited due to copyright and privacy laws. If there is enough interest expressed, the annual performance is recorded and a professional DVD/USB and photographs are available for purchase.

(d) Tickets to the annual performance are an additional cost. You will be notified by Strive when the tickets become available.

11. Costume Policy For Annual Performance

(a) If a student agrees to participate in an annual performance they will be required to purchase and be responsible for the cost of, a costume per dance item in which they feature as well as the annual show fee.

(b) School Class costumes are $50 (GST inclusive).  Public Class costumes are $60 (GST inclusive).  Show fees are $35 per student ($45 for a family with 2 students and $50 for a family of 3+ students)

(c) You will be billed for your costumes during Enrolment Term 3 with your Enrolment Term 3 dance fees to enable costumes to be made or purchased in time for the shows in Enrolment Term 4. If you are not participating in the show you must let us know before the end of week 5 of Enrolment Term 3.  After this date if you have not already informed us that you will not be dancing in the show, you will still be required to pay for your costume and can, of course, keep it.

(d) A portion of the costume fee goes towards extras we provide/purchase which include but are not limited to accessories, touch-up makeup, extra hair spray and clips, baby wipes and disinfectant required for the show (“Accessories”). Accessories remain the property of Strive.

(e) Both the Enrolment Term fee and costume fee must be received in full before the costume is released to the student.

(f) Once payment is made, the costume will then become and remain the property of the student.

12. Choreography and Music

(a) Strive is licensed with APRA for the use of music for teaching and performance purposes.

(b) Choreography for classes, competitions, and performances remains the sole property of Strive.

(c) Choreography must not be copied or used without prior permission from Strive.

13. Concerns or Complaints

(a) We value your opinion and hope to make you and your child’s involvement with Strive as enjoyable as possible. If you wish to speak to us about any concerns please feel free to contact us at the office via phone or email.

(b) If you are not happy with the service you have received or the behaviour or attitude of any staff member please tell us as we may be unaware there is an issue.

14. Privacy Act and Privacy Policy

(a) To ensure we have all relevant personal details about our students, we will collect and keep information about you from time to time.

(b) This information includes the information you provide on your enrolment form and updates you may provide us with.

(c) You need to ensure that the information you give us is true, correct and complete.

(d) Under the Privacy Act 1993 you are entitled to have access to, and request correction of this information.

15. Communication Policy

(a) For the purposes of the Unsolicited Electronic Messages Act 2007 you consent to receive communication from Strive.

(b) It is the responsibility of all parents and students to read emailed newsletters.  Please note we do not provide printed copies of newsletters.

(c) If you have not received our newsletter via email, please check your junk inbox, you may need to make us a safe sender.

(e) Any changes to personal details (email address, phone numbers, address etc) should be immediately updated through your parent portal login on the Strive website to ensure our records are kept up to date.

(f) If you are experiencing difficulties getting emails please contact Strive by phone or email.
